SCHAUMBURG CASE DISMISSED IN COURT

SCHAUMBURG, Ill.- The lawsuit filed by the Village of Schaumburg, Ill., against UniSite Inc. was dismissed in federal court after UniSite agreed to follow local zoning procedures, said city attorney Jack Siegel.

UniSite agreed to apply for a “special use” permit, which it received. Special use entitles a party to locate a structure once the party has proven that the site is not a threat to public safety.

The ruckus started when UniSite started constructing a tower on U.S. Postal Service property. The company has an exclusive contract with the post office to build towers for wireless systems. The post office is exempt from local zoning authorities in certain projects. UniSite maintained it could build without local zoning approval.

Schaumburg disagreed, arguing the post office is not exempt from local authority when structures are used for commercial gain.
