SAN DIEGO-Qualcomm Inc. and Ericsson Inc. settled one of several lawsuits pending between the two companies.
The agreement, filed June 6 in federal court, resolves the patent infringement lawsuit Qualcomm filed against Ericsson in March.
For the seven-month term of the agreement, Ericsson and its affiliates will not make, sell or offer to sell, use, import or commercially introduce in the United States any Code Division Multiple Access subscriber products or equipment unless such products or equipment have been licensed by Qualcomm or unless Ericsson first gives Qualcomm 30 days notice of Ericsson’s intended activity.
Based on the agreement, Qualcomm dismissed without prejudice its patent infringement claims against Ericsson. Ericsson also agreed that for the next seven months, it will not file any lawsuit against Qualcomm or any of its customers or licensees related to Ericsson’s actual or intended CDMA subscriber products or equipment without giving Qualcomm 30 days prior notice. The companies further stipulated that if any such lawsuit arises, it can proceed only in San Diego.
The agreement does not affect other litigation filed last September between the companies, which is pending in Texas, nor does it impact a federal lawsuit filed last year against Ericsson by Oki America Inc. in which Oki is seeking a judicial declaration that its CDMA products do not infringe upon certain Ericsson patents.
