NEW YORK-A company called Beatie, King & Abate L.L.P. has filed a class-action lawsuit
against Lucent Technologies Inc. individually and as a successor to AT&T Corp., alleging its telecommunications
products sold between 1990 and Jan. 13, 1999, are not Y2K compliant.
Lucent could not be reached for comment at
RCR deadline.
The lawsuit, filed in New York State Superior Court in New York City, alleges: “As a
consequence of defendants’ actions, many customers purchased and used their telecommunications products without
knowing at the time of purchase that the products contained the year-2000 defect, which will, on or before Jan. 1, 2000,
render those products inoperable, ineffective, and obsolete before the end of their useful lives.”
Products
referred to in the lawsuit include voice-mail and other communications systems.
According to the lawsuit, BKA,
headquartered at 599 Lexington Ave. in New York City, purchased some of the communications products in or about
January 1996. The company is seeking compensatory damages for all members of the class. BKA also is asking the
court to force Lucent to put in an escrow account all revenues it has received from selling products during the class
period that the court finds to be affected by Y2K problems.
