WASHINGTON-U.S. District Judge Catherine Blake of Baltimore said she plans to dismiss the US$800 million cancer lawsuit against the mobile-phone industry by the end of the month.
Blake, who gutted the case of plaintiff Christopher Newman by rejecting expert testimony of key witnesses in a 30 September ruling, notified the parties late last week of her intentions in advance of a motion for summary judgment that was being prepared by industry lawyers.
Newman’s lawyers said they will appeal the decision.
Blake still oversees nine brain-cancer lawsuits against industry and several class-action lawsuits seeking to secure relief for consumers who were not supplied by carriers with radiation-reducing headsets.
