WASHINGTON-Lawyers for Christopher Newman later today are expected to appeal last month’s dismissal of an $800 million brain cancer lawsuit against Motorola Inc.
U.S. District Judge Catherine Blake of Baltimore threw out the lawsuit on Oct. 31, after ruling the previous month that Newman failed to provide sufficient scientific evidence to support his claim. The Law Offices of Peter G. Angelos, which represents Newman, will challenge the Blake decision at the U.S. Court of Appeals for the Fourth Circuit in Richmond, Va.
The wireless industry has tried to steer all federal lawsuits on health to Blake. She is poised to rule on various class action suits that claim the cellular industry misled consumers about alleged radiation risks from mobile phones and on a request to transfer a brain cancer suit back to federal court in San Diego.
Elsewhere, a panel of federal judges in Savannah, Ga., is expected to rule by early next year whether Blake should oversee six brain cancer suits against the cellular industry that were originally filed in Texas, Georgia and the District of Columbia.
