CHICAGO-Cingular Wireless L.L.C. has filed a lawsuit to stop the publication of portions of a deposition given by an executive in a related lawsuit.
“In one of the more unusual business decisions by Cingular Wireless in its ongoing litigation with Kempner Mobile,” reads a statement released by Kempner.
Kempner and Cingular are involved in litigation regarding business practices. Kempner won round one when a judge said its contract’s prohibiting it to sell other products besides Cingular’s was unenforceable.
The litigation is set to continue this June. In the meantime, Kempner has set up a Web site www.cellulardealerlawsuit.com and posted portions of the deposition given by Laren Whiddon, Cingular’s regional vice president. Cingular is suing to have this content taken down from the site.
Cingular did not immediately return calls requesting comment.
