Proxim ordered to pay damages to Symbol in patent lawsuit

SUNNYVALE, Calif.-Proxim Corp. will be required to pay $25.9 million in damages to Symbol Technologies Inc. for infringing on patents, according to the U.S. District Court for the District of Delaware, which upheld the September 2003 verdict and rejected Proxim’s post-trial motions.

Proxim, however, is not enjoined from continuing to sell the products in question, and the court denied Symbol’s request that it impose a court-ordered royalty on future sales of the products.

“We are pleased with this decision by the court, particularly the validation of the 6-percent royalty assessed for infringement of Symbol wireless patents,” said Peter Lieb, Symbol’s senior vice president and general counsel. “We believe Symbol’s intellectual property is a strategic asset of the company, and this decision is another example of Symbol’s superior track record in defending our intellectual property.”

Proxim said it has anticipated such a ruling, and therefore, the decision will not result in any change to its financial statements.
