WASHINGTON-The EMR Network petitioned a federal appeals court here to review a three-judge panel’s rejection of a challenge to how the Federal Communications Commission crafts radio-frequency radiation safety guidelines for mobile phones and antenna towers.
The U.S. Court of Appeals for the District of Columbia Circuit ruled against the EMR Network, a wireless health advocacy group, in December.
“The court should grant rehearing en banc to review the arbitrary and capricious action of the Federal Communications Commission in refusing to initiate or to request accurate up-to-date RF radiation scientific research in the biologic health effects of continuous exposure of innocent bystanders, particularly children, to the rapidly expanding quantity and range of RF radiation from high-frequency wireless transmissions,” Whitney North Seymour Jr., a lawyer representing the EMR Network, stated in a Jan. 13 court filing.
In 2000, the U.S. Court of Appeals for the 2nd Circuit affirmed the FCC’s RF radiation exposure standard.
