Vivendi charges Deutsche Telekom, Elektrim with fraud in Poland

PARIS-French company Vivendi Universal has filed a complaint in Poland against its co-owners of wireless carrier Polska Telefonia Cyfrowa.

Vivendi Universal filed a complaint against Elektrim and Deutsche Telekom related to the bilateral agreement between France and Poland for the protection of investments. Vivendi is charging that a series of acts constitute a fraudulent abuse of process, and that the Polish justice system has taken no steps to rectify the alleged fraud.

Vivendi said the two companies are attempting to deprive Vivendi of its interests in PTC.

DT owns 49 percent of PTC, and Vivendi said the remaining stake is owned by a joint venture between Vivendi and Elektrim. However, a Polish court ruled Elektrim owned the bulk of the remaining shares. Then DT said it acquired the Elektrim shares, giving DT a 97-percent stake in PTC.

For its part, Vivendi Universal said it supports the appeals and criminal complaints filed by Elektrim Telekomunikacja and PTC and has contacted the Polish government to demand compliance with the law.

Vivendi and Deutsche Telekom have been battling for control of PTC, the country’s largest wireless carrier, for several years.
