WASHINGTON—A health-related suit to block the June 29 start of the advanced wireless services auction has been re-filed at the 2nd U.S. Circuit Court of Appeals in New York.
On Thursday, plaintiff Maria Gonzalez and her attorney Whitney North Seymour Jr. withdrew a similar suit from a U.S. District Court in New York after the Justice Department raised jurisdictional objections. The new suit was filed Friday in the 2nd Circuit.
Gonzales wants the 2nd Circuit to order the Federal Communications Commission to prepare an environmental impact statement in advance of the AWS auction. The suit claims failure to do so violates the National Environmental Policy Act of 1969.
