Patent, lawsuit and Qualcomm Inc. seem to a close knit clan as of late-the company is notorious for closely protecting its patents, a practice that routinely puts it at a loggerheads with its competitors over patented technologies. Indeed, Qualcomm is currently embroiled with Nokia Corp., Broadcom Corp. and a number of others players.
But there is at least one more battle that will never reach a court room: Upaid Systems Ltd. agreed to dismiss all patent-related claims it made against Qualcomm in the Eastern District of Texas, Qualcomm announced today. In court filings made in July 2005, Upaid claimed the San Diego-based company and Verizon Wireless were infringing on two U.S. patents relating to pre-paid and pre-authorized communication services and transactions.
According to Qualcomm, Upaid agreed to dismiss its suit after unspecified facts were discovered during the litigation. Both companies have entered a complete settlement, which gives Qualcomm royalty-free, worldwide license to U.S. Patent Nos. 6,320,947 and 6,714,632, and any related patents. Upaid also agreed to not sue Qualcomm for the use of the BREW system or any other Qualcomm data service.
