A Virginian jury ruled in favor of TeleCommunication Systems Inc. in the company’s patent-infringement battle with Sybase Inc., awarding TCS a one-time payment of $12.1 million for past royalties. Sybase said it would appeal the verdict.
The issue stems from TCS’ patent No. 6,985,748, which the company said covers inter-carrier text-messaging technology. TCS argues that Sybase’s text-messaging service infringes on the patent. Sybase acquired Mobile 365-which supplies inter-carrier text messaging services to a number of wireless carriers in the United states-in November.
“We are pleased the U.S. court upheld our inter-carrier messaging patent, validating our innovative research and development and our leading messaging solutions,” said Maurice Tose, chairman, president and CEO of TCS.
The battle is one of a large and growing number of patent-infringement cases in the wireless industry.
