Chip maker Broadcom Corp. confirmed it complained last month to the U.S. International Trade Commission, alleging that Qualcomm Inc. is violating the ITC’s ban on importing, testing or marketing chips using Broadcom’s “983” patent.
Qualcomm has endeavored to find a “workaround” solution that would circumvent Broadcom’s patent, which was upheld by the ITC earlier this year, and Broadcom’s complaint alleges that its rival’s workaround infringes on its patent. Broadcom said it is seeking fines and additional orders from the ITC regarding Qualcomm’s allegedly continuing infringement.
“Regarding Broadcom’s latest complaint filed with the ITC, the commission is not taking a position on Broadcom’s complaint and has referred it to an administrative law judge for handling,” Qualcomm said in a statement. “Any timeframe for handling will be set by the administrative law judge. In the meantime, the stay on the downstream exclusion order remains in place.”
