Supreme Court affirms decision absolving Motorola and NYC from blame related to 9/11 attacks

WASHINGTON-The Supreme Court affirmed a lower court decision preventing families of New York firefighters killed at the World Trade Center on Sept. 11, 2001, from suing Motorola Inc. and New York City over allegedly defective two-way radios.

The 2nd U.S. Circuit Court of Appeals concluded the families waived their right to pursue litigation because they accepted payments from the Sept. 11 Victim Compensation Fund.

Reps. Henry Hyde (R.-Ill.) and Carolyn Maloney (D-N.Y.) unsuccessfully urged the Supreme Court to review the 2nd Circuit’s ruling.

“Motorola is pleased with the decision of the U.S Supreme Court to let stand the ruling of the U.S. Court of Appeals that dismissed the Virgilio lawsuit. The Supreme Court ruling is appropriate and speaks for itself,” said Motorola spokesman Steve Gorecki. “Sept. 11 was a horrible and tragic day, and our hearts go out to those who lost family members and loved ones.”
