SAN DIEGO-The Delaware Court of the Chancery has denied Texas Instruments Inc.’s motion to dismiss in the breach of contract dispute over Qualcomm Inc.’s claim to some CDMA patents.
The court said Qualcomm “has alleged facts that, if accepted as true, may support a finding that the breach of the contract is so substantial that it defeats the object of the parties in making the contract.”
Qualcomm sued TI for breach of CDMA patent portfolio agreement in July, 2003.
