Sendo, Microsoft case to be heard in Texas court

BIRMINGHAM, United Kingdom-Mobile phone startup Sendo said its case against Microsoft Corp. will go ahead in a Texas courtroom instead of moving to Washington. Microsoft had filed a request for the case to be moved to its home state.

Further, Sendo said the court will hear its claims against Microsoft of fraud, unfair competition, breach of contract and misappropriation of trade secrets. The court dismissed claims of civil conspiracy and neglect of fiduciary duty. Sendo said it could file for punitive damages if the company proved a case against Microsoft.

“Basically, the case is moving ahead,” said Sendo spokeswoman Marijke Van Hooren.

Sendo filed suit against Microsoft last year, following the breakdown of a deal between the two companies to build a phone using Microsoft’s Smartphone operating system.
