Motorola wins spam lawsuit against Paging America

BOYNTON BEACH, Fla.—Motorola Inc. emerged the victor in its lawsuit against Paging America, which used Motorola’s brand name and products in its e-mail spam campaign.

In an Illinois federal court default judgement, Paging America must pay Motorola $100,000 in damages for counterfeiting and $100,000 for violations. The company must also give Motorola all its advertisements and related materials for destruction, and must provide Motorola with the names of any customers who responded to the e-mails.

“Consumers recognize and trust the Motorola brand as a provider of high-quality products and services,” said Miguel Pellon, Motorola’s vice president and general manager for the wireless messaging division. “When our reputation is damaged by the fraudulent practices of others, we have no choice but to take legal action.”

Digital Wireless Technologies d/b/a Paging America sent spam e-mail offering free Motorola pagers, which Motorola said were neither free nor made by the company.
