ALEXANDRIA, Va.-PCIA has filed a reply to an environmental group’s response to PCIA’s motion to dismiss the group’s Aug. 27 Gulf Petition.
The environmental group, which consists of the Forest Conservation Council, Friends of the Earth and the American Bird Conservancy, contends antenna structures in the Gulf Coast region pose a risk to birds, and the Federal Communications Commission should conduct a post-construction review of the towers in the region.
PCIA argues that the Federal Communications Commission’s regulations comply with the National Environmental Policy Act (NEPA) and requirements of the Council on Environmental Quality (CEQ).
“The law is clear, and precedent backs it up,” said Jay Kitchen, president and chief executive officer of PCIA. “There is no legal validity to this petition, which is why PCIA is asking the FCC to dismiss it.”
