WEBCEL CONTINUES CHALLENGE OF FCC’S 18-GHZ SPECTRUM

WASHINGTON-WebCel Communications Inc. continues to push forward with its challenge of a Federal Communications Commission 1997 decision to reallocate spectrum from the 18 GHz band to the 24 GHz band, a ruling that settled a long-running dispute between Teligent Inc. and Teledesic Corp.

Congress at one point weighed into the licensing fracas, but later bowed out.

WebCel, represented by Wiley, Rein and Fielding, argues the FCC’s failure to give “required notice and comment is arbitrary, capricious, an abuse of discretion, and otherwise not in accordance with law.”

Teligent filed to dismiss the case.

A briefing schedule and oral argument date have not been set.
