Palm says Court rejected Xerox motion in handwriting patent infringement case

SANTA CLARA, Calif.—Palm Inc. said the U.S. District Court in Rochester, N.Y. rejected a motion made by Xerox Corp. pertaining to Xerox’ 1997 claim of patent infringement that alleged Palm’s Graffiti handwriting symbols violate Xerox’ computerized handwriting recognition patent.

The court refused to stop the sale of Palm Powered handhelds in the U.S. and did not set a trial date to determine damages Xerox says it is owed, noting that Palm’s appeal is still pending. “We intend to pursue our appeal vigorously … For thousands of years, people have been creating writing symbols. Xerox does not own the alphabet,” said Eric Benhamou, chairman and chief executive officer of Palm.
