XO, FBI, Justice reach agreement to allow ownership transfer

WASHINGTON-XO Communications Inc., the FBI and the Department of Justice last month entered an agreement which will allow XO’s fixed-wireless licenses to be transferred to a new ownership group, 40 percent of which is owned by Telemex (Telefonos de Mexico S.A. de C.V.).

The agreement, which was signed on Sept. 16, was released by the Federal Communications Commission on Oct. 4. It certifies that XO’s facilities will still be available to law enforcement when necessary. The FBI and Justice Department have become increasingly concerned that foreign-owned companies will thwart law-enforcement investigations.

XO has been going through a lengthy bankruptcy proceeding, the conclusion of which requires the FCC to approve of the license transfer.
