SUNNYVALE, Calif.-The heated and rancorous legal battle between corporate wireless e-mail companies Research In Motion Ltd. and Good Technology Inc. moved another step forward, with a California judge denying RIM’s calls for an injunction on Good and pushing the case further toward a jury trial.
Both companies issued statements following the judge’s ruling, seeking to color the events in their favor.
“Judge Cannon found that RIM failed to demonstrate a probability of success on the merits of any of its claims,” Good said in a statement. “This is the second time the California court has denied RIM’s requests for injunctive relief in the ongoing RIM vs. Good litigation.”
RIM provided a detailed account of its legal fight against Good, explaining that it has filed four separate lawsuits against the company alleging patent infringement issues, unfair competition, false advertising, trademark infringement, misappropriation of trade secrets and breach of contract.
“RIM asked the court to enjoin Good Technology from using customer information that RIM contends was misappropriated from RIM,” RIM said in a statement. “Good Technology represented to the court that it is no longer using the allegedly misappropriated customer information and based upon that representation the court denied RIM’s request for further relief.”
RIM said the judge set a status conference for June 3, and RIM said it plans to proceed against Good in all of its separate lawsuits.
