WASHINGTON-Texas officials plan to re-file criminal charges against a man who allegedly was using his cell phone when his vehicle hit another car, killing two family members in January 2002.
Adolfo Aguilo, assistant district attorney in Corpus Christi, Texas, today said he hopes to re-indict Regino Salinas “hopefully sometime soon” this year for criminally negligent homicide-including a new deadly weapons charge in connection with the deaths of Jose Gonzalez, 44, and Sotero Garza Gonzales, 68.
The trial was set for Aug. 11. District Attorney Carols Valdez asked the judge for a delay because a key witnesses-the state trooper who investigated the deadly accident-was in Florida. The judge and defense lawyers opposed the request, prompting Aquilo to file a motion to dismiss the case. If found guilty, Salinas could be sentenced to up to 10 years in a state jail.
Rene Rodriguez, a lawyer for Salinas, plans to introduce evidence that the location of the car crash is a dangerous intersection.
