FCC DENIES QUALCOMM IN PIONEER RULES PETITION

WASHINGTON-The Federal Communications Commission has denied Qualcomm Inc.’s petition for reconsideration of the commission’s second Report and Order concerning pioneer’s preference rules.

The commission did, however, grant Celsat America Inc.’s petition for reconsideration of the FCC’s third pioneer’s preference report and order.

In ruling against Qualcomm, the commission stated that a technology used successfully in one service can’t be given a pioneer’s preference in a new service, and that two pioneer’s preferences would not be awarded for the same technology used in different services.

The FCC will allow Celsat and other applicants to file amended pioneer’s preference requests.
